Activist Federal Judge Overturns Part of Law Protecting Unborn Life and Women’s Health

Austin – U.S. District Court Judge Lee Yeakel ruled today in favor of Planned Parenthood striking down provisions in House Bill 2 protecting the health of women and unborn life because they interfere with the rights of abortion physicians and clinics.

The ruling eliminates the common sense requirement that abortion physicians have admitting privileges at a hospital within 30 miles in case of a medical emergency.

Senator Estes criticized the ruling as an unelected judge irresponsibly attempting to legislate from the bench by overturning the will of the Texas people.

Senator Estes echoed the sentiment of Lieutenant Governor David Dewhurst who said in a statement, “I am saddened by the court’s decision to overturn certain elements of HB2 which were written to protect the health of Texas women. It is disturbing to know that the abortion industry is celebrating a so-called victory that actually reduces the standard of care for the women from whom they profit.”

Estes added, “I guess this opinion means that Texas women and unborn children have fewer rights than abortion doctors and clinics. I emphatically, whole-heartedly, unapologetically disagree with this ruling. I believe that Texas women and unborn children have just as many, if not more, rights than abortion doctors and the places where they do their gruesome work.”
